BY REQUESTING THE FRIEND OF DISH CARD YOU AGREE TO THE FOLLOWING TERMS & CONDITIONS:
1. Application of Terms and Conditions
These terms and conditions will apply to the provision by Tangible Media Ltd trading as Dish Magazine ("Dish") to you of the Friend of Dish Card ("Card") and the receipt of rewards by you through your use of the Card ("Reward").
2. The Rewards
(i) You must comply with all directions provided by Dish in relation to the Card. You must also comply with all directions from the parties who are providing the Reward to you ("the Suppliers"). To claim a Reward you must:
(a) expressly advise the Supplier that you are utilising the Card when booking at their premises for a meal;
(b) to order and pay for the meal/goods at the premises of the Supplier;
(c) show the Supplier the Card when attending upon the premises;
(d) Dish accepts no responsibility for the failure by any of the Suppliers to provide the Reward to you and/or for the Reward itself, and you shall have no claim against Dish in this regard.
3. The Card
The Card is provided to you subject to the following:
(a) The Card remains the property of Dish;
(b) Should you lose the Card Dish are under no responsibility to replace it or honour the terms of this agreement in any way;
(c) The Card is not a credit card, and cannot be used for any other purpose other than as detailed herein;
(d) The Card is not transferable;
(e) Dish may provide a Card at their discretion up until Dec 31, 2009. The provision of the Card in these circumstances is at the sole discretion of Dish and you shall have no claim against Dish should you not receive the Card.
4. Exclusions and Limitations
(a) Dish excludes all implied conditions and warranties except any implied condition or warranty the exclusion of which would contravene any statute or cause any part of this clause to be void.
(b) To the extent permitted by law, Dish’s liability to you for breach of any term of this agreement is limited, at its option, to refunding the price of the Goods and/or Services in respect of which the breach occurred or to providing, replacing or repairing those Goods and/or providing those Services again.
5. Indemnity
You indemnify Dish against all expenses, losses, damages and costs that it may sustain or incur as a direct or indirect result of a breach by you of any of your responsibilities under the terms of this agreement.
6. Termination
(a) Dish may terminate or suspend this agreement with you:
(i) if you breach any provision of this or any other contract and fail to remedy the breach within 7 days after our notice requiring you to do so;
(ii) if you breach a material provision of this or any other contract where that breach is not capable of remedy;
(iii) upon the provision of fourteen (14) days notice without cause
7. Force Majeure
Dish will not be liable for any failure to perform or delay in performance of any obligation where such failure or delay is due to anything beyond its reasonable control, including but not limited to adverse weather or terrain, strikes, lockouts and other industrial action, raw material shortages, accidents, power failure, breakdowns of plant or machinery or import or export regulations or embargoes.
8. General
(a) Any failure by Dish to insist on strict compliance with any term of this contract or any delay by Dish in exercising its rights under this contract will not constitute a variation or waiver of any provision of this contract or of any right available to Dish.
(b) If part or all of any provision of these terms and conditions or its application to any person or circumstance is illegal or unenforceable, the provision will be interpreted so as to ensure it is not illegal or unenforceable. If any provision or part of it cannot be so interpreted, the provision or part of it will be severed from these terms and conditions and the remaining provisions of these terms and conditions continue in force.
(c) Where you comprise two or more persons, an agreement or obligation to be performed or observed by you binds those persons jointly and each of them separately.
9. Privacy
(i) Dish shall only collect personal information that is lawful and fair, and this information shall only be used for the purpose of collection;
(ii) Dish shall take reasonable steps to protect the personal information it holds;
(iii) You shall have access to the personal information Dish holds and you may correct it if necessary;
(iv) Dish shall not intentionally collect sensitive information about you unless you have consented to this.
10. Governing Law
Any contract between Dish and you will be governed by the laws of New Zealand.
